I have been employed in Senior Contracts/Commercial / Risk Management roles for several decades and thus possess extensive international experience, knowledge and skills in managing and controlling all aspects of the contractual and commercial issues on many major and diverse multi-billion US Dollar Construction projects, worldwide, reporting to Boards of Directors, Partners and/or Senior Management as appropriate.
Specifically and essentially, I possess;
- a) A complete understanding and
interpretation of the terms and conditions in international Contracts such as all the FIDIC Forms of Contracts including the EPC Lump Sum Turnkey Contract as a Specialist.
- b) A considerable ability to utilise the understanding /interpretation of all terms and conditions to benefit my employers contractually and commercially.
- c) A complete understanding of the roles of the parties to a Contract and their respective rights and obligations including the relevance of time-scales.
- d) A thorough knowledge of the design and construction processes both pre and post-contract award including managing and controlling the procurement process, pre-qualifying Contractors, Subcontractors and Suppliers, Managing and controlling tender (bid) processes and preparing and issuing tenders, Managing and controlling bid evaluations, negotiations and award recommendations. Providing contracts and procurement advice and/or assistance to other members within the project’s team and ensuring that all agreements are completed in accordance with the project’s requirements in every respect.
- e) The ability to work with and assist the Project Director/Manager on all contractual/commercial issues on a daily basis.
- f) A thorough knowledge, understanding and experience of dealing with local contractors, subcontractors and suppliers.
- g) A wealth of experience in disputes management including the preparation submission and settlement and or rebuttal of contractual claims for additional entitlement whether Extension of Time (EOT) or additional payment or both. In addition, the experience, knowledge and understanding of the stringent procedures to follow to ensure a claim is successful, whether a claim has any validity or otherwise, the paramount need of contemporary records necessary to ensure any claims success and the experience to clearly identify claims from Contractors, Subcontractors and/or others are “genuine” claims or otherwise, or those based purely on conjecture or supposition.
- j) Excellent communication skills both oral and written in the English language and the specialised ability to use the nuances of English to great advantage when composing contractual/
commercial correspondence on any matters that may become contentious.
- k) Extensive experience working with multi-national teams and the need to exercise diplomacy and discretion as appropriate.
- l) A pragmatic proactive and analytical approach to all contractual/ commercial issues that may arise.
